Does a Limited have genuine legal capacity and is contractually capable?
Yes, basically, the Limited is legally and contractually capable EU wide. It all started off with the decision of the European court of justice on the 5th of November 2002 in agreement with the federal court of justice in Germany (BGH) in 2003, where the freedom and right of establishment of a company within the EU was set. This means that a Limited company only needs to have its registered office in the UK and can then legally and contractually trade anywhere in the EU
